1. About

ZaiFitness, accessed via the website, www.ZaiFitness.com is an online website, focusing on digital material in relation to male model photography and video.
Although its content will appeal to gay men, it's not limited to the LGBT community. The purpose of the website is to make digital media collection, in relation but not limited to models with attention to good fitness. All models featured, have agreed to have their content on the website and have freely collaborated under their own will, previous agreement and model release forms.
 

Users of the website need to subscribe in order to access all the content of the website. ZaiFitness is not an adult website, therefore all contents on the website are suitable for all ages. However, parental guidance can be advised. Photography and video contents, are made in an artistic, sensual and at times, erotic way which might imply sexual desire or sexual connotations. However, there are no naked scenes, models do not perform any sexual acts nor there are any references that associate the contents of the site to an adult site. 


The subscription cost is collected as part of the service to provide the website, it's administration and featuring models hosting their content, such as videos and images collected on this site.

 

We reserve the right to make changes to these Terms at any time and at our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Website thereafter. By continuing to use ZaiFitness.com after such notice, you agree to these Terms as modified. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you. 

 

We reserve the right at any time and without notice to:

  • Modify, suspend or terminate ZaiFitness.com or any portion thereof.

  • Delete any content on ZaiFitness.com if in our reasonable opinion it does not comply with these Terms and/or applicable law;

  • Disclose information about your use of ZaiFitness.com in connection with law enforcement investigation of any suspected or alleged illegal activity, or in response to a lawful court order; or

  • Change the payment processor that enables you to make payments as a user. Increase the payment fees or offer discounts.

 

2. How It Works

 

What is ZaiFitness.com about?  ZaiFitness is not an adult website, therefore all contents on the website are suitable for all ages. However, parental guidance can be advised. Photography and video contents, are made in an artistic, sensual and at times, erotic way which might imply sexual desire or sexual connotations. However, there are no naked scenes, models do not perform any sexual acts nor there are any references that associate the contents of the site to an adult site. 
The website is aimed for gay men, but not limited to the LGBT community. It includes a collection of exclusive photography and videos comprising of models and amateurs who collaborate with us for making digital contents. In order to access all content, users need to register and pay a subscription fee to become a member of ZaiFitness.com.

 

What can I find on ZaiFitness.com? The content includes a collection of exclusive photography and videos, related but not limited to men's fitness. Most models are of Asian origin and perform topless, to pose in sensual and at times erotic scenes to display their bodies and muscles.

 

Why do I need to pay a subscription? This is the service we provide to view all content hosted on the site, which has been put together focussing on the topic and theme of the site, in relation, but not limited, to men's fitness.
The subscription goes towards the maintenance and administration of the website. All digital content, is subject to its own copyright and intellectual property rights.

All purchases made on ZaiFitness.com are final and non-refundable. You are entitled to cancel any subscription, for any reason and at any time, thereby ensuring that you will not be billed again for that subscription. 

User's are responsible for their own payments and correct card details. If the registered card fails to make a payment, there are no funds on the card, it is declined, expired, or is lost or stolen, the user must update/notify us with new payment information. ZaiFitness.com reserves the right to suspend or cancel the membership of the user, prior email notification, on the date that the mis-payment occurs.

 

What do I need to provide? Only basic personal information is needed from you. First, you need to subscribe and pay the subscription fee. A valid debit/credit card will be required to complete the payment form. (Note payments are taken by a third party agent. The website and the organisation of ZaiFitness.com does not store nor has access to your payment details). After successful payment, you will be redirected to the next page where you need to sign up. Enter the details; email, name, country of residence and password of your choice. Once you have successfully signed up, you will get an email to confirm your membership is pending.

Once we have verified your payment and your account on ZaiFitness.com, we will then activate it, in a period of less than 12* hours. You will be notified of this via email, receiving 2 emails, automated from our system.
*Please note that at times it can take longer to activate a membership due to additional checks, technical or system updates or admin staff downtime.

To successfully activate your membership, users need to use the same email for the payment subscription and the sign up to the website. This will link the two steps. 

 

3. Account Registration

To register and create an account on ZaiFitness.com, you must provide a valid email address, a username, and a password. It is a requirement for the user of the Website that all the information you provide on the Website is correct, current, and complete. To access all the content you will need to pay a subscription fee; this proves your age and passes the security check to access the site. Note, all payments are processed by third parties. ZaiFitness.com does not store or has access to your payment details.

You agree that all information you provide to register with this Website, is accurate and correct. The use of any features on the Website is governed by our Privacy Policy at ZaiFitness.com/privacy policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

 

When you register on ZaiFitness.com, you agree to use the site for your own personal use and not for commercial use. Video contents at ZaiFitness.com, is available to download. User’s own discretion is advised and you must agree to comply with the intellectual property of such digital material. If users download videos via software, ZaiFitness.com does not hold any responsibility of the effects of these actions. ZaiFitness.com does not hold any responsibility if users download models videos and share them via other platforms, as this is beyond our control. 

You, the user, are fully responsible for any and all activities that occur on your account and you are responsible for keeping your login details confidential and secure. 
You agree not to disclose these details to any other person or entity and immediately notify us at support@zai-fitness.com if you believe someone has used or is using your account without your permission or if your account has been subject to any other breach of security. 

We have the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time and at our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms. 
 

 

4. Subscriptions and payments:

In order to become a member and access the site, you need to complete two steps, Subscription + Sign up.
Once you have completed both steps, you will receive an email informing you, regarding your payment type membership and your membership activation.
All purchases will appear in the acronym of "ZAI Subscription", to guarantee discretion and privacy to the user. All purchases are final and non-refundable. However, you may cancel your subscription at any time by accessing https://www.zaifitness.com/account/cancel. Your billing period will allow you to access the content on the site until the end of the existing billing period, where you will lose access to the content and not be re-billed, if you choose to cancel. This would be notified by email when the recurring payments have been successfully cancelled and also inform the user of the last date of membership to the site.  

 

You are entitled to cancel any subscription, for any reason and at any time, thereby ensuring that you will not be billed again for that subscription. 

 

Important:  Any purchases made on ZaiFitness.com which don’t match the user’s registered details for will result in the user’s account being immediately and permanently excluded from ZaiFitness.com. 

 

4.Payment forms and refunds: 
We accept major credit cards, debit cards and American Express cards worldwide. Payments are taken by ZOHO Checkout and are displayed in USD American Dollars. It is also possible to use Discover cards and Union Pay cards depending on the location and financial institution agreement of the card. We recommend to use however, Visa or Mastercard.

Users who subscribe to the website, will have the period of validity of their membership in which to sign up to the website in order to activate their membership. If for some reason a user, does not sign up, the amount paid will not be refunded at the end end of the validity, but the subscription will be cancelled and will not incur into a recurring amount. The user will receive an email informing them about the cancellation made by us.  
 

Refunds may also be offered for any users who pay twice on the same day, due to error or mistake, as the membership can take up to 12 hours to be activated.
This can be requested in writing to support@zai-fitness.com, explaining the reasons to have paid twice. Refunds are subject to consideration. Extension times can be offered instead in order to give the users the full time, of any payments they have made to the website.

 

5.Prices and coupons: 

At times, we may offer discounts and promotions to users. These discounts and coupons are issued in partnership with our payment host provider and reserve the right to withdraw these discounts or coupons at any time without prior notice. Discounts and promotions may include free subscriptions to the website, extension of recurring payments to give extra months of service at no extra cost, 1 month or more free subscription or discounts for one or multiple months.
All users, independently of full, partial or free subscription, must complete the subscription process in order to access all content of the website.  

Coupons are only valid for new users unless stated in the individual coupon below. If any recurring user applies a coupon at checkout and is not charged, we will commence the activation of the account after completion of the first successful payment. This will be informed to the user by email and the date of activation, pending payment.

 

At present we have the following active coupons with their respective conditions:

ZAI50: When successfully applied, the coupon gives the user a one off discount of 50% the value of the first month subscription. After the first month, the charge will revert to the normal monthly payment which the user selected. Users can cancel their subscription anytime and their membership will remain until the last day of the cycle. We will remove access to the site on the last day of the subscription. Coupon is only valid once per email and signup, as per new member.

 

Lock Price Benefit: Subscribing to the site comes with the "lock price" benefit which means the user will pay the same amount every month, irrespective if the price goes up. This amount will be specified on the payment page at the beginning of payment. All recurring payments made by the user thereafter will be the same, as long as the user maintains the current subscription. If the user cancels the subscription and wants to re-subscribe again, the price may have changed, since the first membership. The current price is $6.99 per month. User's are responsible for their own payments and correct card details. If the card expires, is lost or stolen and does not update/notify us with new payment information, ZaiFitness.com reserves the right to suspend or cancel the membership of the user, prior email notification warning, on the date that the mis-payment occurs.
 

6. Promotions: From time to time we may launch promotions and discounts. We reserve the right to withdraw such promotions for any given reason without notice or modifying these terms.  Currently we have the following promotions active:

-Extra 30 days on the 3xMonthly Subscription: When a new member successfully subscribes to this subscription plan, there is a 30 day automatic extension which is applied to the user account, giving the first time recurring period a total of 4 months from the day of payment. This offer is only valid for new members using a new email and new card number. Returning customers who have already benefited from this offer, will be charged again after 3 months from the payment being made.

 

6.1 Join as a Model Terms: ​ZaiFitness.com offers the change for models and amateurs to join us in media productions. Models and amateurs who apply must meet the following criteria to be accepted for the consideration to collaborate with us:

 

-Be at least 18 years of age or more.
-A defined / lean / muscular body with interest in fitness and working out.
-Showing face is required. However, total discretion is offered and we do not tag you in our content unless requested by the models. 
-Smooth / Shaved upper body is preferred (to showcase better the muscles). 
-Sample Content sent must be in original quality and format. (MP4, AVI for videos or JPEG, PNG for Photos).
-HD content is preferred. (Bad quality videos or photos will be rejected).

We reserve the right to withdraw the model application or change the requirements at any given time without notice. We also reserve the right to delay, or reject selected models, if we decide that at the time, we no longer need their participation. We also, may cancel collaborations, for a media collaboration or shoot if we encounter any admin or technical difficulties. Users who submit their application for promotion are bound by these terms and also accept the privacy policy of our website. (https://www.zaifitness.com/privacy)

 

7. Account Deactivation

7.1Should you wish to deactivate your ZaiFitness.com account, please contact customer support at support@zai-fitness.com to submit your deactivation request. We will deactivate your account within 24 hours after receiving your request. You will receive an email to confirm the cancellation.

Users are also able to cancel their membership by completing the "Cancellation form" at the Members Area Menu. Once completed, an automated response will be displayed on the site to confirm the request for cancellation. We will then proceed to cancel the membership within 24 hours and inform the user by email when the subscription has been cancelled succesfully.

 

7.2Recurring payments:
Are automatically generated by the system when the user subscribes to the site. It is the user's responsibility to ensure they have enough funds to cover the next payment.
f the payment fails on the renewal date, we will honour 3 extra days and send the user an payment failure notification to warn the user about the unpaid balance. 

If the user does not add funds or does not update the card information for payment, on the second attempt of payment, the balance will remain unpaid and the users account will be deactivated and the membership cancelled. Once the membership is cancelled, any user wanting to access the website again, will need to re-subscribe, but note, the price may differ from the original price they paid at the beginning.

7.3Unsubscribing from marketing emails:
If you signed up to the website you will be registered automatically in receiving marketing emails. To cancel the email notification service or unsubscribing, please click the button at the end of the page where it displays "Unsubscribe". This will take you to the page where you will have to complete your email address to deactivate the marketing emails. Users who do not subscribe, but sign up only will be kept in the system database for 2 months. After this date they will be deleted. Any user can re-sign up in the future and subscribe to the website, if they so wish.
 

8. Intellectual Property Rights 

The ZaiFitness.com® name and logo and all related names, domains, products and service names, designs, and slogans are trademarks (®) of ours.
ZaiFitness® is registered division of the parent company with trademark in the United Kingdom under Planet Airlines Ltd with company number 10695472 with it's registered office in London, EC1V 8DB, (United Kingdom).  You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Website and its content are the trademarks of their respective owners. 

 

We do not warrant that ZaiFitness.com is compatible with all devices and operating systems. It is your sole responsibility to determine whether or not ZaiFitness.com is compatible with your device. From time to time we may make updates to the website without prior notice, which may become inaccessible for a short period of time.

Any content posted that is reported by another user at ZaiFitness.com, and that is deemed unacceptable by ZaiFitness.com, will be deleted. If you are a parent or legal guardian and become aware that your minor-child has registered on ZaiFitness.com, and would like to deactivate the account please immediately notify us at support@zai-fitness.com.

By registering an account with ZaiFitness.com, you represent and warrant that:

  • You are at least 18 years of age; 

  • You will fully comply with these Terms;

  • You accept full responsibility for the use of ZaiFitness.com on any device, whether or not it is owned by you; 

  • Your use of ZaiFitness.com will not violate these Terms or any applicable law. 

 

9. ZaiFitness.com Content:

The content which displays on ZaiFitness.com is owned by us, registered by copyright and signed by both producers and models to agree the media production and distribution on the respective platforms that we manage. Media Contents are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Service, together with our Privacy Policy, govern your use of ZaiFitness.com, including any content, functionality, and services offered on or through the Website. By registering with and using ZaiFitness.com, you hereby accept and agree to be bound by and abide by these Terms. We are not responsible or liable to any third party for the content or accuracy of any content posted in our site.

By using ZaiFitness.com, you acknowledge and agree as follows:

We also do not warrant or guarantee that ZaiFitness.com and all of its services and features will be available at any particular time or location; that ZaiFitness.com and all of its services and features will be secure, uninterrupted, and error-free; that any defect or error will be corrected; or that ZaiFitness.com and all of its services and features will be free of viruses and other harmful components.
